MADRID PROTOCOL: Payment of the Second Part of the Individual Trademark Fee at JPO

The JPO has adopted an individual fee consisting of two parts under the Madrid Protocol for trademark registration. The application will be cancelled if the second part of the individual fee is not paid within the period indicated in the NOTIFICATION OF SECOND PART OF INDIVIDUAL FEE. Be sure you pay the second part to assure your trademark is registered in Japan!

1. How to Pay the Second Part of the Individual Fee
Once the JPO decides to grant a trademark registration, it issues a DECISION TO GRANT A TRADEMARK REGISTRATION. You will also receive the STATEMENT OF GRANT OF PROTECTION from the WIPO and NOTIFICATION OF SECOND PART OF INDIVIDUAL FEE from WIPO. You must file the payment with WIPO in accordance with the NOTIFICATION OF SECOND PART OF INDIVIDUAL FEE.

2. When to Pay the Second Part of the Individual Fee
The due date for paying the second part of the individual fee is Three (3) Months from the transmission date indicated on the STATEMENT OF GRANT OF PROTECTION, which is the same date indicated on the NOTIFICATION OF SECOND PART OF INDIVIDUAL FEE.

3. Is There a Grace Period?
If the payment fails to be filed within the designated period, there is a grace period of Two (2) Months from the due date of the payment to revive the trademark application. You must file Form MM20 (REQUEST FOR CONTINUED PROCESSING) and an additional fee of 200 Swiss Francs, further to the amount of the second part of the individual fee.
